LTFRB warns of illegal logistics, delivery service operations

Metro Manila, Philippines – The land transport regulator issued a stern warning to motorists involved in the unauthorized operation of logistics services without proper permits, saying such operations are punishable by law.

The Land Transportation Franchising and Regulatory Board (LTFRB) said Thursday that the modus violates its Joint Administrative Order No. 2014-01, with metes and punishments including impoundment of the unit and a fine of up to ₱200,000 per unit.

Citing an investigation report, the LTFRB said some private motor vehicle owners, trucks and vans in particular, are illegally accommodating online e-commerce marketplaces and shopping platforms for transport, logistics, and delivery services.

Acting LTFRB chairman Greg Pua Jr. flagged these operations as colorum and called them “very unfair” to legitimate operators complying with necessary regulatory requirements.

Pua underscored that the issue is not only about securing a Certificate of Public Convenience or valid authority issued by the agency but also about road safety, given that vehicles used for these logistical operations undergo roadworthiness inspections.

“This is a fair warning to all those involved in this modus. We have already started our operations against you in coordination with law enforcement agencies. Your only options so far are to stop or get the necessary permit for your operation,” Pua said.

He added that lawful logistical operations require 60% to 40% ownership and control by Filipino citizens as enshrined in the Constitution and as stipulated in the Public Service Act, as amended by Republic Act No. 11659.

Infringement of these laws imposes a serious penalty on violators with imprisonment of six years and one day to 12 years, a fine not exceeding ₱2 million, or both.
