Comelec orders proclamation of re-elected Benguet Rep. Eric Yap
Metro Manila, Philippines - The Commission on Elections (Comelec) has ordered the proclamation of reelected Benguet Representative Eric Yap.
The poll body issued a certificate of finality on Wednesday, July 2, directing the Benguet Provincial Board of Canvassers to reconvene and proclaim Yap after his proclamation was suspended.
The suspension stemmed from a disqualification case filed by a certain Franklin Tino who said the lawmaker does not have Filipino parents and has lived in China.
The Comelec second division dismissed the petition as Tino failed to prove his claims. The petitioner did not file an appeal.
“A Resolution or Final Order is deemed final and executory if, in case of a Division ruling, no motion for reconsideration is filed within the reglementary period, or the motion for reconsideration is denied,” the resolution stated.
“The Resolution of the Commission (Second Division) promulgated on 26 June 2025 is hereby declared IMMEDIATELY EXECUTORY,” it said.
Yap won the midterm polls with 144,093 votes.
