Kian murder ruling fuels Palace call for independent probe on drug war killings

Metro Manila, Philippines – Malacañang said the Supreme Court decision that affirmed the murder convictions of three police officers in the killing of teenager Kian delos Santos strengthens calls for an independent truth commission to deeply examine alleged extrajudicial killings linked to the previous administration’s anti-drug campaign.

Acting Communications Secretary Dave Gomez said on Tuesday, Dec. 23, that the decision highlights proposals raised by church leaders, civil society groups, and some members of Congress on creating a body that will focus on extrajudicial killings.

“We still need to review the Supreme Court decision,” he said.

“This development underscores the need to consider the proposal from the church, civil society, and some members of Congress for an independent Truth Commission to probe more deeply into these extrajudicial killings,” he added. 

The Supreme Court on Dec. 22 upheld the murder convictions of Caloocan police officers Arnel Oares, Jeremias Pereda, and Jerwin Cruz for the 2017 killing of the 17-year-old during an anti-drug operation under the administration of President Rodrigo Duterte.

In its ruling, the court said “the elements of murder were present,” citing treachery under the Revised Penal Code. It found that Delos Santos had no chance to defend himself and was deliberately attacked.

The killing of Delos Santos ignited nationwide outrage in 2017 and became a symbol of criticism against thousands of alleged extrajudicial deaths during the drug war.

Palace officials said the ruling underscores the importance of accountability and could shape broader efforts to examine abuses connected to the campaign.

Duterte has been detained at an International Criminal Court facility in The Netherlands on charges of crimes against humanity for murder in relation to his drug war.
