Video proof not required when returning defective product – DTI official

Metro Manila (CNN Philippines, June 20) – Customers are not required to provide a video of opening the parcel to the seller when returning a defective product, the Department of Trade and Industry (DTI) said Tuesday.

Yung produkto na mismo, kung defective siya, yun na yung ebidensya natin. Hindi kailangan ng video kasi hindi naman dapat pahirapan pa ng seller ang buyer para makapag reklamo siya,” DTI Undersecretary Ruth Castelo told CNN Philippines Newsroom Ngayon.

[Translation: The product, if it’s defective, will be the evidence. There is no need for a video since the seller should not make things difficult for the buyer to file a complaint.]

Customers were reminded to also keep the receipt of the defective product, as it will serve as proof when filing a complaint.

Castelo said most complaints that the DTI received so far involved deceptive and defective products and false advertisements.

E-commerce transactions are also protected by RA 7394 or the Consumer Act of the Philippines, she added.

The law states that “the service supplier is liable for redress, independently of fault, for damages caused to consumers by defects relating to the rendering of the services, as well as for insufficient or inadequate information on the fruition and hazards thereof.”
